Section 27
Provisions relating to classification of information

(1) In order to protect information related to sub-section (3) of section 3 in public bodies, there will be a committee as follows to classify information in a policy manner:-
(a) Chief Secretary to the Government of Nepal – Chairman
(b) Secretary of concerned Ministry – Member
(c) Expert in the relevant subject designated by the head of office or the chairman - member
(2) For the purpose of classification of information, the committee under sub-section (1) shall determine certain criteria for the period of how many years the information related to sub-section (3) of section 3 should be kept confidential and also the method of preservation and give the same information to the commission.
(3) A person who is not satisfied with the classification made by the committee in accordance with sub-section (2) may apply to the commission for review that such information should be made public.
(4) Upon review of the application made under sub-section (3), the Commission shall order the disclosure of the information if it is not deemed necessary to keep it confidential.
(5) According to the nature of such information, classified information according to sub-section (2) may be kept confidential for a maximum period of thirty years.
(6) Notwithstanding anything written in sub-section (5), the committee shall review every ten years whether the information to be kept confidential should be kept confidential or not.
(7) When reviewing in accordance with sub-section (6), if such information is to be kept confidential for an additional period, the period to be kept confidential shall be opened, and if it is not to be kept confidential, it may be classified as not to be kept confidential.
